The Privacy Commissioner Reported on the Proposed Amendments to the PDPO to Combat Doxxing at the 55th Asia Pacific Privacy Authorities Forum

The Privacy Commissioner for Personal Data, Hong Kong (Privacy Commissioner), Ms Ada CHUNG Lai-ling, attended the 55th Asia Pacific Privacy Authorities (APPA) Forum held virtually from 16 to 18 June 2021.
 
Major themes discussed at the APPA Forum included the following:
  • Legislative developments in the protection of personal data;
  • Privacy issues in the new normal post COVID-19;
  • Use of emerging technologies and engagement with industries;
  • Children’s and adolescents’ privacy; and
  • Formulating global standards in data protection.
 
In the discussion session on legislative developments, the Privacy Commissioner updated APPA members on the Government’s proposals to amend the Personal Data (Privacy) Ordinance to curb doxxing activities. The Privacy Commissioner explained to APPA members the elements of the new doxxing offence, and her new criminal investigation, prosecution and enforcement powers under the Government’s proposals.
 
During the discussion session on the privacy issues relating to COVID-19, the Assistant Privacy Commissioner for Personal Data, Ms Diana PANG, introduced the functions of the “LeaveHomeSafe” app to APPA members. Ms Pang also explained the privacy-friendly designs of LeaveHomeSafe, such as the absence of registration requirements, no location tracking functions and the storage of visiting and vaccination records on users’ smartphones.
 
The Assistant Government Chief Information Officer from the Office of the Government Chief Information Officer, Mr Jason PUN, also spoke in the session of “Digital Identity” and gave a presentation on “iAM Smart”. Mr PUN highlighted the functions of and the privacy protection measures incorporated into iAM Smart, such as minimising, and encrypting, the amount of personal data kept for the one-stop mobile app, and making it mandatory to obtain users’ consent before collecting or using such personal data.
 
Founded in 1992, APPA is the principal forum for privacy and data protection authorities in the Asia Pacific region to strengthen cooperation, discuss best practices and share information on privacy regulation, new technologies and the handling of privacy enquiries and complaints. The 55th APPA Forum was hosted by the Personal Information Protection Commission, Republic of Korea.
