Suspected Use of a Reporter's Photo as Facebook Profile Picture


In relation to many media enquiries about an individual reportedly having used a reporter's photo as Facebook profile picture, the office of the Privacy Commissioner for Personal Data, Hong Kong (PCPD) responds as follows:

  • The PCPD notes that the data subject concerned and the media organisation she works for have openly stated that they would lodge a complaint to the PCPD. Upon receiving the complaint, the PCPD would pursue investigation in accordance with the Personal Data (Privacy) Ordinance and gather the relevant facts to ensure fair enforcement of the law.
  • Since an investigation will be conducted, the PCPD would not comment on the incident.
  • As regards other questions raised by the media, they relate to an injunction order and intimidation, which are not within the remit of the PCPD. The PCPD would nevertheless collaborate with the relevant law enforcement agencies insofar the issues concern about personal data privacy.
