Response to media enquiry: domestic helpers to report employers for suspected unlawful acts

Personal data privacy issues are set out in the Personal Data (Privacy) Ordinance (Ordinance), Chapter 486, Laws of Hong Kong.

Under this Ordinance, encouraging helpers to report on suspected crimes is not a privacy issue.

Helpers’ reporting on suspected crimes using relevant personal data of their employers may be justifiable if they honestly believe that crimes were committed.

Employers who believe that their personal data has been misused by helpers may lodge a complaint to the Privacy Commissioner for Personal Data, Hong Kong.
